I later went on to have children of my own, which gave me even more reason to become a teacher. And even with the economy the way it is today, there are actually a lot of opportunities for teaching given the wide variety of jobs a teaching degree can obtain. I also understand the responsibility that comes with teaching and that the job doesn’t end when you leave the classroom. That is why I respect the teaching field as much as I do. I know I still have a long way to go before I get to my teaching career but I feel it will all be worth it when I get there. Having the chance to help kids is a great advantage by itself. You never know what they may have going on outside of the classroom. Being a teacher will give me the ability to provide them with not only education, but a lot more. I can be there to give them structure, advice, influence, and support when they need it. I feel all of these are essential for a great learning experience and I would love to be one of the ones to give that to them. In the long run being a great teacher can result in changing someone’s life for the better and not even knowing. Giving them the confidence they need to succeed all throughout life. Letting them know your there to help with any problems they may have even if they aren’t class related can make all the difference. The opportunities are out there. Having a teaching degree can put you in several different places. There are daycares, public and private schools, troubled youth, and special needs. And for those who like to make their money on their own time can tutor privately. I can work all year, or be off work all summer. There is no limit to what you can do as a teacher as long as you enjoy teaching. My preference would be to have the summers off. Although I also like the idea of being able to work some during summer if need to make a larger salary. That is why I hope to obtain a job working for the city school district when I finish my own education, mainly because of me having children of my own. I would almost always be off work when they are out of school. That would give me so much more time with them to help with homework, participate in sports and other extracurricular activities. We could go on vacation in the summer, go to the zoo, museums, and just have fun as a family. I know when I can finish school and start in my teaching career my kids will be so proud. I want them to be proud to tell people that their mother is successful. I wouldn’t have to pay for childcare which is also a plus. So being a teacher I would not only have more time with my kids but I would also have more money for us to do the family stuff we want. I also am ready for the responsibility of teaching and what the position requires of me. I may leave the classroom in the afternoon, but my work still goes home with me. Papers to grade, lessons to plan, and decisions to make, and guidelines to follow will be a part of my everyday process. The obligation to the deadlines itself will be a challenge but at the end of the day I know it will all be worth it. I’ll be so happy with my life. I cannot wait to get my schooling finished so I can get my teaching career started. The first day I have a class full of smiling faces will be the happiest day of my life. Setting my goals and succeeding in them is a great accomplishment itself. The respondents body is shamed by being referred to as charcoal (in relation to its black colour) and on a worse note the Chinese man felt that by the respondent entering the pool it meant that the man and his wife should leave the pool and that they cannot be in the same pool together. One only has to look back into Singapores history and remember of the two racial events that nearly tore apart Singapore The Maria-Hertogh Riots and 1964 Race Riots. On 11 of December 1950 the court decided to award custody of Maria Hertogh (who was raised by Muslims) her biological Catholic parents. Outraged Muslims protested the decision which eventually led to rioting when images showing Maria Hertogh kneeling before a statue of Mother Mary were published. Rioting in Singapore lasted 3days. Many properties were destroyed but more importantly 173 people were injured and 18 were killed. The next day the Chinese student will have to live in the Indian students house. This thus creates the social interaction required to foster harmony between the different racial groups. The reason for implementing this system during primary school is because young children are impressionable and through interaction at this age it will continue a trend to interact with other races as they grow up. Over the past few decades, with the development of contract law, more and more people has paid attention to the exclusion clauses contained in a document which is signed by the parties. Many contracting parties use this technique to avoid liability for breach of contract. In this essay, exclusion clauses can be defined as a clause included in a contract to either limit or exclude liability of a party in breach of the agreement. (also termed exemption clauses or exemption clauses. ) Consequently, it is argued that whether the party will be bound by the exemption clause which is signed by the parties or not. Therefore, this essay will analyze the exemption clause with signature based on several court cases and illustrate the effect of an unsigned exemption clause by using a short hypothetical scenario and a court case. Signed Exclusion clauses As a general rule, a person who signs a document which contains contractual terms is bound by the clause of the document. To be specific, if a party signs a contractual document incorporating an exemption clause, it will automatically form part of the contract. Therefore, Signature can ordinarily bind a person to the terms even if he has not read or understood the terms set out in the document. What has come to be known as the principle in L’Estrange v Graucob was expressed by Scrutton LJ as follows: ‘When a document containing contractual terms is signed, then, in the absence of fraud, or, I will add, misrepresentation, the party signing it is bound, and it is wholly immaterial whether he has read the document or not. ‘ According to the case of L’Estrange v Graucob [1934] 2 KB 394, the plaintiff bought an automatic cigarette machine from the defendants. She signed a contract called sales agreement which include several clauses, but did not read. When she discovered the machine was defective, she tried to sue Graucob for breach of contract, but the defendant was able to rely on the exclusion clause incorporated into the written contract. From this case, it can be seen that since the plaintiff has signed the sales agreement, the contract and the exclusion clauses has taken effect. In addition, the contents of the document were represented correctly and no fraud on the part of the defendants. Therefore, L’ Estrange is bound by the exclusion clauses. However, the rule in L’ Estrange v Graucob will not apply under some circumstances. Firstly, if the signed document could not reasonably be regarded in the circumstances as likely to contain contractual terms, the party will not be bound by the signature. In the case Le Mans Grand Prix Circuits Pty Ltd v Iliadis, the plaintiff was injured while driving a go-cart at the defendant’s racing track. P was invited there as a guest to help the promotion of D’s go-kart track and did not pay for the attendance at the track. The defendant wanted to avoid liability by relying on an agreement, signed by the plaintiff which includes an exclusion clause. The count made a decision that the defendant was unable to rely on the exclusion clause so as to avoid liability. Because the plaintiff attended defendant’s track was not in pursuance of a commercial dealing of relationship with the defendant. Thereby, the entry form was just a driver registration form, not a contract. The case of Curtis v Chemical Cleaning and Dyeing Co clearly illustrate the legal position. In this case, Curtis took a wedding dress to the defendant’s shop to have it dry cleaned. The shop assistant asked her to sign a ‘receipt’, and the plaintiff was told by the shop assistant that the document was to exempt defendants from liability for damage to the beads and the sequins. The plaintiff signed the document, which in fact included a clause that the company is not liable for any damage howsoever arising. The dress was stained by the defendant who later tried to rely on the exclusion clause. The Court judged that the clause is not effective and the defendant cannot rely on it. Because in this case, the exclusion clause had been misrepresented as only beads and sequins would be affected. and the plaintiff thought she was only running the risk of damage to the sequins and the beads on the dress. Another court case for the unsigned exclusion clause is the case of Parker v South Eastern Railway Co, plaintiff left his bag at cloakroom in a railway station and he got a ticket. On the front of the ticket said ‘See back’, the other side include an exclusion clause which shows that company will only be responsible for the value of package within 10 pounds. When the bag could not be found, Parker sued the company for 2410 pounds. However the court judged that the plaintiff was bound by the exclusion clause on the ticket even though he did not sign it. Because the company has already gave the plaintiff sufficient notice of the existence of the clause and a reasonable person would expect to find these terms. According to the basic principle in contract law which said that the unsigned exemption clause will be bound if reasonable notice has been given. Conclusion To sum up, exclusion clause can be classified as signed document and unsigned document in this essay. When considerate the effectiveness of a clause, every aspects should be analyzed. Although the signature is an important factor to prove if the clause is valid, it does not mean that all the exclusion clauses included in a signed document can be bound with a signer. The presenter on the water conservation was a man who is in charge of the water preservation in Santa Monica. The presentation was very interesting and had great deal of information about proven water conservation tactics. The topics covered included everything pertaining to consumer water usage and misusage. The topics included varied from water content in the soil to less water consuming showerheads to newer ways of watering the lawn. In order to understand the in-home usage one must first understand the nature of water usage in the global scale. He pointed out that most of the time societies use more water than needed. Some examples of places where people overuse water are in resorts, hydraulic dams, outdoor pools, basking in the showers, overflowing tubs, and so on. What is interesting is that in order for water to get to us individually it needs to use energy to generate enough pressure, and if we use less water, hence we use less energy. Hydralic dams use the most amount of water, and if we consume less energy we will use less water. Drying and cooling take the most amount of energy. His next topic in the presentation was about understood the Hydrologic cycle. The hydrologic cycle is when water on earth becomes dry enough and goes into the air as steam, than under right conditions when it’s high enough in the atmosphere and it meets a with the cool air the steam becomes liquid and falls down as rain. We dry up the air, from freeways, residential surfaces, and commercial surfaces, and if the air is not cold enough than the water will rarely liquefy. Now in order to battle this situation he presented with three possible solutions. First by cutting down on driving, with correlation of roof gardening we will to keep the air cool. Secondly we will save water by changing habits and fixtures, conserving water and energy. Third way is by reusing the water instead of throwing it away, this could be done by installing grey water systems. It is when the dirty water is recycled instead of going to the ocean. Next step in the presentation was about how we as individuals can do to conserve water. He broke down water conservation into two parts, the indoor and the outdoor. What we can do indoors is to do the simple things, like not letting the water on when brushing our teeth, not taking extensive showers, not leaving the water on for hours and forgetting about it. Another easy way to use less water is putting a half full bottle of water in the back of the toilet to deter it from using a lot of water. This is especially a good idea for old toilets models which in general use more water than needed. The best amount of water per flush is 1. 5 GMP; the transition is slow, but persistent. He also mentioned other ways of water conserving that included buying a water conserving showerhead, using toilets with dual flush systems, for hard and soft waste. And in general looking at everything inside the house that uses water and trying to see if one can reduce its water consumption. An example would be to buy a more water efficient dish washer, and a washing machine. However he talked more extensively about the outdoor techniques of water conservation. He said that about half of the water used in homes is consumed outdoors. He also stated that about 20% of energy in California is spent of the transportation of water. Another very interesting aspect about water consumption that he spoke of was the usage of plants in the landscaping of houses can greatly reduce the amount of energy that is required to cool them. He also mentioned the fact that people sometimes make a mistake of watering their plants more when there is a problem. According to the speaker there could be many reasons that a plant is unhealthy such as bad soil, positioning, and bugs. Since watering plants and the lawn is such a huge consumer of water, he suggested inspecting plants regularly, finding out what kind of soil is required for a great plant, positioning the plants to face the sun, hence reduce the amount of sunshine on the house, and saving energy. Also watering the lawn differently could help reduce water consumption. He spoke about drip irrigation, which is a very smart way of irrigating. It does not irrigate the whole lawn but the important parts of it where the plants are located. What makes the food so good? Does the atmosphere make the yum factor even better? What about the staff how do they contribute to the yum factor of the food? For this evaluation I would like to explore this yum factor and truly understand what makes the Red Robin chain of restaurants stick with yum as a marketing tool to entice customers to come in. Firstly we will explore the atmosphere of the Red Robin restaurants and how the atmosphere adds to the yum factor. When you first walk into a Red Robin restaurant you are greeted by a friendly hostess who joyfully takes you and your party to your table. Once you are seated your server comes over to greet you and take your drink order. This is great for the yum factor because no one like to eat food in the mist of negativity, when you are in a place where the atmosphere is negative it just makes your whole entire experience bad. The one down side to this is that at times if you have children, you are still in the process of settling in; you are not quite ready for your server to come by and take your drink order because you have not even looked at the menu. Secondly we must discuss the staff and how they add to the yum factor for Red Robin restaurants. The staff at Red Robin is for about 95% of the time the friendliest and warm restaurant staff you will encounter. The staffs at Red Robin restaurants are very accommodating for anyone who needs to place a special order. They are also good about getting food to children first, especially if it is later in the evening and they are hungry. This ability to get what I desire to eat the way that I desire it without having to be reprimanded for substituting this for that or adding this or that, makes the yum factor so much better because it is truly what I want. However, the one con that I have seen of the Red Robin staff is that, they are not prepared for last minute large parties. There have been times when a group of friends have decided to just go and have a great time eating together, the staff takes about thirty minutes to get their selves together to be able to accommodate the crew. Lastly, we must discuss what makes the food so good and how it makes the yum factor. The food at Red Robin consists of burgers, French fries, select chicken products, salads and sandwich wraps. The burgers are considered gourmet because they have more than just your typical bacon, cheese, ketchup and mustard. The food theme for Red Robin is classic comfort with a twist of class to heighten your taste buds. On the other hand when it comes to the food some may find that the classiness of some of the items is too much for them. Some people just want a simple cheeseburger with no muss or fuss, and with all the gourmet burgers this may be a turnoff to those people. The uniqueness of the food is what gives Red Robin the yum factor, the food is comforting and the flavors are bold.
